Illinois Residency Requirements Allow Elected Officials to Continue to Hold Public Office In Illinois, Even After Moving to Another State

As a result of the residence requirements for public office in Illinois, it seems to be the case that a person could hold elected office in Illinois while living in another state. According to the Chicago Tribune, this came as a surprise to parents of Illinois’ Crete-Monee school district when concerned resident, Tammy Burnham, began asking questions about one of the school board members, Edward J. Anderson, Jr., and found out that his absence at recent school board meetings was due to the fact that he lived in Jacksonville, Florida. Records indicated that Anderson had filed for incorporation, listing himself as the corporation’s registered agent and listing his address as a Jacksonville apartment. Further, his house in Crete has been in foreclosure for months, and Burnham claims Anderson’s neighbors told her that Anderson indicated he did not plan to return. It appears based on the facts that Anderson has moved to Florida—but he remains on the school board in Crete, and he cannot be removed for having left.
Recent New Jersey State Election Law Limits Delivery of Mail-In Ballots by Authorized Individuals

On August 10, 2015, the New Jersey legislature passed a new state election law, Public Law 2015, Chapter 84, which limits the number of “Vote by Mail” ballots that a designated delivery person can pick up and deliver on behalf of other registered voters. Under the New Jersey “Vote by Mail Law,” an “authorized messenger” is an individual who is permitted to obtain mail-in ballots for other qualified voters. Previously, authorized messengers were allowed to obtain up to ten ballots for delivery to other voters, and “bearers” were permitted to return an unlimited number of completed ballots to county election boards on behalf of other voters. The new law, which took effect immediately, reduces the number of ballots that both an authorized messenger and bearer can deliver to just three. This change in the law (you can see the previous version of the law here) represents the first time there has been any limit on the number of ballots that a bearer can deliver to county election officials.
California’s New Motor Voter Law Benefits the Young, Not Undocumented Immigrants

California Governor Jerry Brown has signed legislation that will allow for automated voter registration at the DMV for citizens obtaining or renewing a driver’s license or state ID. The law is being referred to as the New Motor Voter Act. California lawmakers are attempting to combat historically low voter turnout rates in the state by removing barriers to registration. The law will go into effect on the first of 2016, but it may not be immediately implementable. The goal is to have the system functional by the June 2016 primaries.

Missoula, Montana, is a beautiful city. There are mountains in the distance, tall, deep-green trees everywhere, old buildings – and a rocky, white-swirling river moving through it. No reasonable person seeing Missoula for the first time would think to focus on the city’s current robo-call election law controversy.
This month, parents of students enrolled in Missoula’s schools received automated phone calls containing a message from Missoula’s mayor, John Engen. The content of the message is available on Youtube. In short, the message urges parents to vote on an upcoming bond, tells them where and how they can cast their ballot, and ends with this encouragement: “Thank you for everything you do to support your children, and to ensure a positive future for your family – and our wonderful community.”

Criminals have been stripped of their rights – including the right to vote – throughout history. The revocation of voting rights, known as disenfranchisement, can be traced as far back as ancient Greek and Roman civilization. European colonists carried the concept of disenfranchisement to America, and it has prevailed in modern times despite various challenges. The U.S. Supreme Court ruled that the disenfranchisement of convicted felons does not violate the Equal Protection Clause of the Constitution in 1974, and several years later found that a disenfranchisement law is unconstitutional only with evidence of purposeful racial discrimination. This decision gave states like Nebraska the right to permanently disenfranchise convicted criminals. Although Nebraska originally had one of the harshest disenfranchisement laws – a lifetime ban for ex-felons – a bill passed in 2005 provides automatic restoration of voting rights to felons two years after completion of felony sentence.

All politics is local. That truism (often wrongly attributed to former Rep. Tip O’Neill) has long encouraged politicians to remember the people back home because, ultimately, those people will vote based on the issues that matter to them. But politics is looking a lot less local now. Local concerns have taken a backseat to partisan politics, and local candidates are looking more and more like extensions of their national counterparts. Perhaps these changes can help explain why municipal election voter turnout is plunging across the United States. Indiana, the state with the lowest voter turnout in the country for the 2014 midterm elections, held its most recent off-year municipal elections on November 3.

North Carolina’s Stringent Voter I.D. Law Gets a Make-Over

Amidst ongoing litigation, North Carolina recently passed a new law that changes its controversial voter I.D. laws. The 2013 voter laws were swept in with other changes to elections and, were considered to be the most stringent in the nation at the time. By North Carolina Board of Election’s estimation, over 300,000 voters, 34% of them African American, lacked the necessary photo I.D. The restrictive voter I.D. law sparked public outrage, leading thousands to protest outside the state capitol building in Raleigh in what have become to be known as ‘Moral Mondays.’ On August 2013, the very same day that North Carolina Governor Pat McCrory signed the bill into law, the American Civil Liberties Union, the ACLU of North Carolina Legal Foundation, and the Southern Coalition for Social Justice filed a lawsuit challenging its constitutionality. That case is still ongoing.

In September of 2015, the Brennan Center for Justice published a report based on ten months of research, which looked at problems arising from aging voting machines. First, the report found that a majority of election districts in forty-three states are using ten-year old machines. There are fourteen states with machines fifteen-years or older. Considering the rapid pace of technology in the past fifteen years, these election machines are truly relics of the past. To illustrate how ancient these machines are; in 2000 Wikipedia nor iTunes existed. Many of the voting machines have minimal memory, such as in Allen County where the machine’s memory cards can contain only 250 megabytes of data. Samsung’s new basic Galaxy S6 smartphone can hold up to 32 gigabytes of data, which is approximately 128 times more memory than those machines.
